In February 2013 a captive elephant had killed a girl during the annual temple festival at Cherthala Taluk of Kerala. After investigating the incident forest department had registered case against five persons for violating u/s 8(1)(2),10,12(a) of Captive Elephant (Management and Maintenance) Rule r/w 51 of Wild Life (Protection) Act. During the trial two accused were pleaded guilty and court sentenced them to pay a fine of ₹ 3500/- each and in default of payment of fine to undergo simple imprisonment for 30 days.

Kerala captive elephant owners make a killing by selling ivory
An investigation into the ivory smuggling racket in Kerala has put owners of captive elephants under a cloud of suspicion. Elephant owners who obtain the Forest Department’s permission to trim the animals’ tusks periodically later sell them to ivory sculptors for lakhs of rupees, the department has found out.

Elephant calves smuggling racket busted
Two elephant calves captured from wild and two kumki elephants were seized and four poachers arrested at Namsai district of Arunachal Pradesh on 6 February 2015.

Captive elephant owner convicted in Delhi
In a case registered in 2007, a Delhi court had recently convicted a person for illegally keeping a female elephant calf without any ownership certificate or transit permit. The court held that the accused acquired the alleged elephant in contravention of provisions of sections 40(2)/42/48A & 49 of the Wildlife Protection Act.

Domestic elephant beaten to death and another died in during transport in Kerala
Kerala is infamous for ill-treating of captive elephants, in one such case 21-year old tusker belonging to the Guruvayur Devaswom was beaten to death by mahouts and in another case an elephant died after meeting with an accident while being transported on a truck in Kottayam district.

Captive elephant taken into custody
Live elephant capture was prohibited long years back in India. And it's a known fact that elephants are very rarely bred in captivity. It need to be investigated how an eight year old elephant reached Bihar and brought to Kerala. Smelling an organized racket behind this!!!
