It is suspected that a team of poachers spread electric wires near the sugarcane field near Rajanagar village in the Athagarh forest range area in Cuttack and killed a tusker on 29 July 2013 night.

Maharashtra to announce CBI probe in tiger poaching cases

Maharashtra government is all set to announce a CBI inquiry into tiger poaching cases unearthed in Vidarbha region between October 2012 and May 2013. Gang of organized tiger poachers arrested in June first week by the forest and police officials in Mansar near Nagpur have confessed that their separate teams killed at least 11 tigers in the eight months.

Three leopard skins seized

In two separate incidents three leopard skins were seized on 29 July 2013, Kerala forest officials seized a leopard skin in Kollam district and Uttarakhand forest officials seized two leopard skins in Uttar Kashi district. 

Accused in shahtoosh shawls seizure case acquitted

In February 2003 Delhi Wildlife Department raided an emporium in Delhi and arrested a person with 6 shahtoosh shawls (made from wool derived from Tibetan Antelope). After ten years, a trial court had acquitted the accused. Court observed that the number of contradictions in the testimony of prosecution witnesses regarding incidental aspects and the manner in which the case property was seized and produced before the court, the non-joining of the public/independent witness makes the prosecution story doubtful and it does not inspire any confidence.

Killing of deer near Bor, Maharashtra

Maharashtra forest officials arrested two persons, including a woman belonging to hunting tribe, while cooking meat of deer killed in protected forest area of Kondhali,5 km from Bor Wildlife Sanctuary. Snake charmers convicted in Delhi

Two snake charmers whom were in possession of one Indian Rock Python without any permission or licence in Delhi on April 2006 were found guilty by trial court. Accordingly, both accused are convicted for the offence u/s 9/49 and 49(B)(1) of Wild Life (Protection) Act, 1972, punishable u/s 51 of the Act.

Person caught with mongoose hairs and brushes convicted

Accused apprehended with 9.5 kg of mongoose hairs and 1000 mongoose hair brushes in Delhi on December 2005 was found guilty by trial court and are convicted for the offence u/s 49 of Wild Life (Protection) Act.

One arrested for tiger killing in Kerala

The three-year-old tiger that was found dead at Karappara Estate in Nenmara forest division, Palakkad, on 16 July 2013 is suspected to have been “hunted” down by a local resident. Forest officials have arrested a resident of the workers’ colony of the estate, in connection with the killing. A case has been charged against him under Section 9 of the Wildlife Protection Act.

Sansar and co-accused discharged from MCOCA

Sansar an illegal wildlife trader and co-accused were discharged from the provisions of MCOCA (Maharashtra Control of Organised Crime Act) by a court in Delhi on 16 July 2013. Co-accused discharged along with him are Sudesh Kumar, Ritu, Babu, a proclaimed offender Badal, Narain, Preetam, Lalita Parsad, Satya Bhan, Hira Lal Khatik and Jagdish Parsad Khatik. When discharging from the provisions of MCOCA, court observed that:

(i) That there is no provision under the Code of Criminal Procedure to file a supplementary complaint in
complaint case;
(ii) That provisions of Section 173(8) is applicable to the police report submitted under Section 173(2) Cr.P.C and not to the complaint cases.
(iii) That after taking cognizance, only superior courts can transfer the investigation to another agency in
appropriate cases for further investigation/fresh investigation/reinvestigation.
(iv) That in the instant case, no superior court had transferred the investigation to the CBI authorizing it to
conduct further investigation under Section 173(8) Cr.P.C., thus investigation conducted by CBI is without
any jurisdiction.
(v) That since there is no provision under the Code of Criminal Procedure to file supplementary complaint in a complaint case, CBI can not file the supplementary complaints by invoking the provisions of Section 173(8) Cr.P.C.
(vi) That word 'charge-sheet' as recited under Section 2(1)(d) of MCOCA does not include 'complaint' as
defined under Section 2(d) Cr.P.C.
(vii) That CBI has failed to satisfy the first mandatory requirement of Section 2(1)(d) of MCOCA to invoke the stringent provisions of MCOCA against the accused persons.

Chinese held again with red sanders, this time in Hyderabad

Last month in three different incidents Chinese citizens were detained in Bangalore and Mumbai airport with red sanders in their bags.

Person arrested with tiger skin convicted

In a 23 year old case a trial court in Haridwar, Uttarakhand has convicted a person and sentenced him to three years imprisonment and Rs 10,000 fine in connection with the seizure of a skin each of tiger and leopard. Initially the case was registered against four persons in which two were died during the trial and third was acquitted by court.

Accused arrested with Indian Tent Turtles convicted

An accused arrested by Delhi police on last December with 21 live Indian Tent Turtles has pleaded guilty during the trial and court sentenced him for a period already undergone in J/C and to pay a fine of Rs. 10,000/- for the offence u/s 9, 49 and 49B(1) of Wildlife Protection Act and in default of payment of fine, SI for one week.

Shopkeeper convicted for illegal possession of mongoose hair brushes

A shopkeeper who was found with 320 pieces of mongoose hair brushes and another person with 12 brushes during the raid in Delhi on January 2011 were found guilty by trial court and convicted for the offence u/s 44/49 and 49B(1) of Wildlife Protection Act.
