Appeal filed by accused in wildlife case dismissed

On 22 November 2014, Special Judge CBI-03, Delhi had dismissed an appeal filed by a convict who was sentenced to three years imprisonment by trial court in August 2014. The convict was held by police with a leopard skin on June 2004 at under Roop Nagar police station area.

When dismissing the appeal the court notes that:

The   appellant   has   been   convicted under   Section   51(5)   of   Wild   Life(   Protection)   Act, which provides   that   a   person   found   to   be   guilty   of   offence   for contravention of any provision of the  Act(except Chapter VA and Section 38J) or any rule or order made thereunder, is liable to   be   punished   with   imprisonment   for   a   term   which   may extend to 3 years or with fine which may extend to twenty five thousand  rupees­  or  with  both,  and it  further  provides  that where the   offence committed is in relation   to any animal specified in Schedule I or Part II of Schedule II or meat of any any such animal or animal article, trophy or uncured trophy derived   from   such   animal   etc.   shall   be   punishable   with imprisonment for a term which shall not be less than three years but may extend to seven years and also with fine, which shall not be less than ten thousand rupees.

Leopard or Panther(Panthera pardus skin) find mention in entry no. 16B of Schedule I of the Wild Life( Protection) Act, 1972, and once the contravention of   Section 49 of the Wild Life( Protection) Act, 1972, is proved, the appellant is liable to be punished with minimum sentence of three years and a minimum fine of Rs.10,000/­.  Vide impugned Order on Sentence dated 22.08.2014, the appellant has been sentenced to SI for 3 years and a fine of Rs.10,000/­, which is the minimum sentence attracted to the contravention of Section 49 of Wild Life( Protection) Act, 1972. Since the sentence of minimum imprisonment has been provided under the provision for which the appellant has been convicted, the appellant is not entitled to be given the benefit of Probation of Offenders Act or to be enlarged   on   probation.   The   result   being   the   impugned Judgment/Order on Sentence dated 21.08.2014/22.08.2014, are upheld.  Appeal filed is dismissed.

Forest officials have arrested three tribals in Sathayamangalam tiger reserve, Tamil Nadu on 4 December 2014 for poisoning the tiger to death. After poisoning the tiger to death, the villagers had removed its bones, skin and nails leaving behind the carcass.

Accused acquitted in leopard skin seizure case

Trial court in Delhi had acquitted two persons from Himachal Pradesh whom were caught with a leopard skin by police in July 2010. A complaint on this regard was filed by the wildlife department of Delhi in court. Some of the court observations when acquitting the accused are:

The investigation of the case is not upto the mark. It is pertinent to mention here that  complainant was one of the experienced Wildlife Inspector and had appeared before the court in number of cases and as such better investigation/act is aspected on his part. The complaint appears to have been filed in a mechanical manner and without perusing the records. Had he visited the spot on the date of incident, he must have mentioned the correct facts in his complaint and  he ought to have   done   further   investigation or to   record   the   disclosure   statements   of accused himself as the disclosure statement recorded by a Wild Life Officer is admissible in evidence. Had done so, the fate of the case would have been different. 

It creates doubt over the prosecution story as well as two views and chances of false implication of the accused can not be ruled out.

Bushmeat trading racket busted

Wildlife criminals convicted in Himachal Pradesh

A court in Shimla district of Himachal Pradesh has convicted two persons for offences having committed under Wildlife Protection Act. Court observed that crimes of such nature as in the present one, offence go untreated as they are committed in accusative manner. Therefore, when the offence is committed the convicts are per-se detrimental to the ecological environment and security of the country. If the same goes unpunished or inadequately punished, it may effect the ecological and environmental security of the country.

Both the accused were sentenced to simple imprisonment for a term of two years under Section 51 of the Wile Life Act read with Section 34 of IPC and to pay fine of  Rs. 2,000/-(Two thousand only) each. In addition to that one of the accused further sentenced to simple imprisonment for a term of three years under Section 25 of the Arms Act and to pay fine of  Rs. 2,000/- (Two thousand only). The sentences of imprisonment shall run concurrently.

Tiger brings down crime rate drastically

A stray tiger that has wandered out of the Dudhwa Tiger reserve and has made the forest area in Malihabad, on the outskirts of Lucknow, its new home, has drastically brought down the crime rate in four police stations, namely, Kakori, Maal, Malihabad and Bakshi Ka Talab, in the post one month. A senior police official disclosed that in the past one month since the tiger was first seen in Maal area and then in Kakori, there has been a 90 per cent reduction in criminal activities in the area.

Arms licences issued around Protected Areas

In a Public Interest Litigation, Allahabad High Court issued a direction last month to Uttar Pradesh state government that "We also issue a general direction to the effect that hereafter, no licence under the Arms Act, 1959 shall be granted in the State of U.P. without the NOC of the Chief Wild Life Warden in those areas which fall within the purview of Section 34 of the Act of 1972. The State Government shall take
necessary steps to issue directions to all the District Magistrates concerned to take steps with reference to those arms licences which have been granted without complying with the provisions of Section 34 (3) in respect of those areas which fall within a radius of ten kilometers of a sanctuary".

Accused in leopard skin seizure case acquitted

In a case registered on August 2008 by Delhi police and later prosecuted by Delhi Wildlife Department on seizure of one leopard skin, accused was acquitted by trial court and observed that:

The number of contradictions in the testimony of PWs regarding incidental aspects, the non­joining of the   public/independent witness makes the prosecution story doubtful and it does not inspire any confidence.

Prosecution has neither produced nor proved on record any DD entry showing departure of the aforesaid police personals from PS which creates doubt over their presence at the spot.

No identification memo of the case property was prepared or Placed on record.

PW2 was examined in pre­charge evidence and his further examination in chief was deferred for wants of case property but the case property remained un­identified by him as he was not examined   further   by   the   prosecution.   In   post   charge   evidence   also, case properties were not identified as PW2 opted to adopt his previous statement recorded in pre­charge evidence which was not complete, as his post charge
evidence.

No   identification   mark   was   put   on   the   case   properties   at   the   spot   before sealing the same. Therefore, chances of tampering of case property can not be ruled out and it can not be said that the case property produced before the court are the same case property which was allegedly recovered from the
possession of the accused.

Shahtoosh shawl trader convicted

A local court in Delhi was convicted a trader from Srinagar for illegally keeping 24 shahtoosh shawls with him on March 2000. During the raid enforcement officials from Delhi Wildlife Department had seized 49 shawls in which 24 shawls turns out to be made of under fleece of Tibetan antelope during forensic analysis. Court found that accused is held guilty and is convicted for the offence u/s 44/49 and 49B(1) of Wildlife Protection Act.

Another Veerappan rises in Karnataka

Accused caught with 11 shahtoosh shawls convicted

An accused from Jammu & Kashmir who was arrested by Delhi Wildlife officials with 11 Shahtoosh shawls in November 2002 was convicted by trial court last week. Court observed that from the bare reading of the provisions of section 57 of Wildlife Protection Act, it is clear that prosecution is to prove that the accused was found in possession/custody or control of any part or derivative of any captive animal and until the contrary is proved, which is to be proved by the accused, custody of such person will be treated to be unlawful custody. If the defence of the accused is taken into consideration, same appears to be afterthought and thus he failed to rebut presumption of unlawful custody of Shahtoosh shawls recovered from his possession.

Court held that the prosecution has proved its case beyond reasonable doubt against the accused that he was found in possession of aforesaid wild life articles i.e 11 Shahtoosh Shawls made of/derived from Tibetan Antelope (Pantholops hodgsonii) without any licence or authority. The species of Tibetan Antelope
are specified in Schedule I of the Act and thus accused has contravened the provisions of section 49 of the Act which is punishable u/s 51 of Wild Life (Protection) Act, 1972. Accordingly, accused is held guilty and is convicted for the offence u/s 49 of Wild Life (Protection) Act.

Accused in shahtoosh shawls seizure case convicted in Delhi

Last week a trial court in Delhi had convicted a person who was caught with 9 shahtoosh shawls (made from under fleece of Tibetan antelope) in Delhi on March 2002. The case was registered by Wildlife Department of Delhi government, court held that the prosecution has proved its case beyond reasonable doubt against the accused and he has contravened the provisions of section 49 of the Act which is punishable u/s 51 of Wildlife Protection Act 1972.
